We understand that it is not always easy to think ahead to a time when you will not have the capacity to make your own decisions but in order to protect your loved ones and make life easier for them, you may wish to consider making a Lasting Power of Attorney appointing people you trust to make decisions for you.
Prior to Lasting Powers of Attorney (LPA) coming into place, there existed Enduring Powers of Attorney which were revoked on 1st October 2007 under The Mental Capacity Act 2005.
An LPA is a legal document, that anyone over the age of 18 can make. This allows your chosen attorney to make decisions for you and act on your behalf, if you are no longer able to do so, or if you no longer want to make your own decisions.
There are two types of LPA:

Health and Welfare
A Property and Financial Affairs LPA gives your Attorney the right to manage your finances, pay bills and, if receiving benefits of any kind, to collect the same.
A Health and Welfare LPA gives your Attorney the right to manage your daily routine, medical care and even moving into a Care Home.
When making either of the above LPA’s, you have control over the same and the right to provide specific instructions as to how your Attorney or Attorneys are to act.
Once the LPA is registered with the Office of The Public Guardian (OPG) your wishes are set in place and your Attorney can take over the running of your affairs without delay. It can take five working days to prepare the LPA and 16 weeks or more for the OPG to register the same.
An LPA ends upon your death or if you revoke the same.
