We are here to assist you in both matters of Probate (where there is a Will) and Letters of Administration (where no will has been left). Matters undertaken will be to apply for Probate or Letters of Administration.
Currently the Probate Registry are taking around 16 weeks after application to issue Grant of probate or Letters of Administration.
We can then ensure debts of the Estate are cleared so far as is possible, all monies are called in and assets are distributed in accordance with the Will or the rules of Intestacy.
Length of time this can take is very much dependent on us being supplied with paperwork available, third parties not responding to our correspondence promptly or dealing with unusual assets or items (for example Fine art, Timeshares, shares in private companies etc).
Your legal costs will generally consist of two parts: Disbursements and Costs.
‘Disbursements’ are those costs that are incurred and paid to third parties on your behalf whilst ‘Costs’ are your Legal fees plus VAT at 20%.

The price information below is a general indication of costs based on our experience.

We estimate the costs are likely to range between £1,750 plus VAT of £350 and £2,500 plus VAT of £500 (depending on the number of work hours*) and disbursements for a straightforward grant of probate and administration of an estate, for estates in England and Wales, where:
-
there is no more than one property in the sole name of the deceased
-
there are no more than three bank accounts
-
there are no debts (other than utility bills)
-
there is a valid will appointing executors
-
there is a single beneficiary
-
there are no complications
*Our Hourly rate is £250 plus VAT of £50
Disbursements
Additional costs
The following factors are likely to increase the cost of your matter:
-
not having all of the paperwork available, or having missing or incorrect information that needs investigation and correction
-
third parties not responding to our communications promptly
-
dealing with unusual or complex assets or items (for example fine art, timeshares, shares in private companies, etc.)
As soon as any complications arise we will discuss these with you and agree the fee for the additional work being carried out in advance of any additional work being undertaken.

Obtaining a grant of representation and dealing with the administration of an estate can be complicated and take between 2-16 weeks; collecting assets can take between 2-6 weeks: it can take a further 2-4 weeks to finalise the estate and produce the estate accounts and make sure everything is done properly. At Garwood & Tan we offer a complete estate administration service to deal with everything for you.

Every estate is different, which is why we encourage you to contact us so we can provide you with an estimate outlining a range of potential fees to make sure that you get the right amount of support to meet your individual circumstances. We will update you regularly on your costs throughout the matter so you can stay in control throughout.
