Selling your Property. What you need to know.
If you are looking to sell your property then please where possible, provide us with copies of the following (which should have been received by you when you purchased the same) as the Solicitor being instructed will require the same:
• Title Register and Plan – this is the document from the Land Registry confirming that you own the property and as such will provide Title Number
• Proof of ownership
• Energy Performance Certificate (EPC)
• Lease (if property is leasehold)
• Gas Safe Compliance Certificate for installation of boiler
• FENSA Certificate for installation of replacement windows/doors
• NICEIC Electrical Installation Condition Report (EICR)
When a Solicitor is instructed in respect of a sale, they will obtain from the H M Land Registry Title Register and Plan to confirm that you have the right to sell the same. The Title Register will confirm whether the property is Freehold or Leasehold, in whose name the same is held and whether there is any mortgage secured on it.
Proof of Ownership of a property will be a Council Tax or Utility Bill dated within the last three months. If the property is being sold by you as Executor or Executrix then Solicitors will need to see Grant of Probate if you applied for the same to confirm that you have the right to sell the property on behalf of the deceased. Solicitors will likewise need to see certified evidence of identity in the form of a Passport or Driving Licence.
Energy Performance Certificate (EPC) – all properties should hold a current EPC Certificate and you can check the register here https://www.gov.uk/get-new-energy-certificate to ensure there is one and this is in date. If the EPC has expired and you are using an Estate Agent to sell your property then you can ask them to have an EPC carried out.
Lease – where a property is Leasehold as opposed to Freehold then you should have a copy of the Lease from the occasion of your purchase. If not then the same can be obtained from the Land Registry at a cost of £3.
Gas Safe Certificate for installation of boiler – it has been a legal requirement since 1st April 2005 that any boiler installed require Compliance Certificate. FENSA Certificate for installation of replacement windows or doors – it has been a legal requirement since 1st April 2002 that any windows or doors installed to the property are put in with building regulation compliance and either FENSA or Certass Certificate. If carried out under FENSA and you do not have certificate then duplicate can be obtained by going into the following website https://forms.fensa.org.uk/fensa-certificate
NICEIC Certificate for electrical work carried out to a property – again it has been a legal requirement since 1st January 2005 that if any rewiring or electrical installation work is carried out to a property that this is done in line with Electrical Installation Condition Report (EICR) which is compliant with building regulations. If this work was carried out in line with the same and you do not have a copy of the relevant certificate then a duplicate can be obtained by going into the following website https://www.checkmynotification.com/
